Whistleblowing policy

It concerns the management of complaints raised on specific issues, such as violations of policies and procedures employed by the KLEEMAN Group of companies and/or violation of applicable law (e.g. failure to comply with the Privacy Policy and the principles of the Code of Ethics and Conduct, issues related to financial statements, employment relationships, abuse, discrimination, corruption, theft, money laundering and in general any misconduct that could damage the company's reputation or any attempt to conceal the above mentioned cases).

According to this Policy, employees and/or third parties may raise a complaint either eponymously or anonymously and submit it to one of the complaint channels, or they can express concerns about violations of company policies or legislation.

Please do not use this application for complaints about the Company's products or services. Such complaints should be addressed to our Customer Experience Department and specifically to complaints@kleemannlifts.com.

DECLARATION REGARDING CONFIDENTIALITY & PERSONAL DATA PROTECTION

Do you want to report any behaviour that could put the Company at risk? Do you feel uncomfortable disclosing this information?

We guarantee that this application will enable us to manage all complaints, either raised eponymously or anonymously, in a completely confidential manner as we consider them to be sensitive personal data.

In any case, before submitting a complaint, please keep in mind that all information provided may have implications for those involved. In addition, keep in mind that your complaint refers to specific persons who are entitled to be aware of the complaint and all information that has been collected in relation to it.

Any employees or third parties who report incidents of delinquent behaviour, as well as employees or third parties who may be referred to in the aforementioned reports, have the right to access, update, object to and rectify their personal data as well as to request at any time and free of charge deletion of the data provided under the terms of the General Data Protection Regulation (EU 679/2016 – GDPR).

KLEEMANN is bound to collect and maintain only the data that are necessary according to the principle of proportionality, to delete them in a secure way after three (3) years, unless there are serious reasons that require their retention (e.g. ongoing investigation, pending legal proceedings), to protect personal data from loss, misuse, unauthorized access or disclosure, and generally to ensure that appropriate technical and organizational measures shall be in place to protect it.

Personal data is collected and processed in complete confidentiality by KLEEMANN’s competent employees who have received special training for this purpose.

Moreover, KLEEMANN Group of companies has taken all necessary measures to ensure that individuals who provide information on incidents of delinquent behaviour -considering in good faith that such allegations have a sound basis- will not be harmed personally, professionally, or financially. On the other hand, employees or third parties who voluntarily make false and malicious complaints shall not be protected.

PROTECTION OF ANONYMITY:

The most important principle encompassed in Complaints & Grievances Management Policy is the protection of the complainant (whistle-blower), except in cases of malicious complaints.

Where a malicious complaint is raised, the complainant may request the disclosure of the complainant's identity in order to exercise his/her statutory rights. 

This application protects your personal data, as you do not need to fill in any information that may reveal your identity.

We are solely interested in the information you provide about the reported incident and not in disclosing your identity.

DECLARATION ON THE SECURITY OF THE ANONYMOUS COMPLAINT FORM:

This application uses security technology to protect your anonymity. Protecting the complainant’s right to anonymity constitutes an important principle encompassed by this Policy.

In case you do not wish to file a personal complaint and in order to make sure that you will remain anonymous, please note the following:

  • do not mention any personal information, such as your name or your relationship with the persons involved,
  • do not provide any information that may reveal your identity,
  • use a secure internet connection.

If you wish to maintain your anonymity, you should be aware that it will not be possible for us to contact you to request further information that will assist us in investigating your complaint. Therefore, please either give us as much information and details as you can to assist investigation process or provide us with an email address that will allow us to contact you without revealing your identity to us.

Where you believe that a personal complaint would help investigation process, we assure you that we handle all complaints under strict confidentiality rules and that KLEEMANN will not retaliate in any way against the person who had filed the complaint.
