Protection of persons reporting on breaches of Union law – Law 4990/2022

Dear colleagues and partners,

This is to inform you that as of 11.11.2022, Law 4990/2022, attached hereto, is in force.

1. This law governs the protection of persons who report breaches of Union law provisions relating to the areas listed in Part I of the Annex included at the end of the attached file, breaches affecting the economic interests of the Union under Article 325 of the Treaty on the Functioning of the European Union (TFEU), as well as breaches related to the internal market, as referred to in Article 26(2) of the TFEU including breaches of Union competition and State aid rules, as well as internal market-related breaches with regard to acts in breach of the rules on corporate taxation or arrangements the purpose of which is to secure a tax advantage that negates the scope or purpose of the applicable corporate tax legislation.

  1. In particular, Law 4990/2022 provides for a system of internal and external reporting of breaches of Union law, for the protection of persons reporting such breaches, the organisation of the report submission, the receipt and follow-up process as well as for the sanctions to be imposed in case of non-compliance with the provisions of this law. Furthermore, all Joint Ministerial Decisions (JMDs) issued pursuant to this Law shall specify the report submission, receipt and follow-up process.
  2. Our Company has designated a Reporting, Receiving and Monitoring Officer (hereinafter referred to as RRMO), Mr. Apostolos Chrysostomidis who is in charge of receiving and monitoring the reports to be submitted.
  3. The reports submitted shall bear the name of the persons who have drawn them up.
  4. Reports may be submitted either in writing or orally.
  5. Written reports may be submitted:

•   Either by sending an email to a.chrysostomidis@kleemannlifts.com addressed to the Reporting, Receiving and Monitoring Officer (RRMO) or

•   by post to the following address: “KLEEMANN HELLAS SA, P.O. BOX 25, POSTAL CODE 61100, KILKIS INDUSTRIAL AREA, CONFIDENTIAL” stating “To the attention of the Reporting, Receiving and Monitoring Officer (RRMO)” or “Report according to Law 4990/2022” or any other indication stating that said report is under the provisions of Law 4990/2022.

  1. Oral reports may be submitted by means of a face-to-face meeting with the Reporting, Receiving and Monitoring Officer (RRMO) carried out within a reasonable time period from the date said request was submitted by the person reporting. This request may be submitted in writing or orally or by e-mail to the Reporting, Receiving and Monitoring Officer (RRMO). In this case, a full and accurate record of the meeting shall be kept, drawn up by the Reporting, Receiving and Monitoring Officer  (RRMO), giving the person reporting the opportunity to verify, correct and agree with the text to be drafted by signing it.
  2.
